Apple Tidak Bersalah Dengan Menggunakan Nama ‘iBooks’

Apple memenangkan kasus perebutan penggunaan iBooks dengan salah satu penerbit novel fiksi di US, Black Tower Press.

Berdasarkan berita yang kami kutip dari Cult of Mac, pemenangan kasus ini sendiri disebabkan bukti yang tidak kuat dari pihak penggugat (Black Tower Press) bahwa Apple telah melakukan praktik customer confusion dan penerimaan keuntungan dalam jumlah yang tidak wajar dengan iBooks.

Berikut penuturan dari hakim Denise Cote:

“They have offered no evidence that consumers who use Apple’s iBooks software to download ebooks have come to believe that Apple has also entered the publishing business and is the publisher of all of the downloaded books,” wrote the judge, “despite the fact that each book bears the imprint of its actual publisher.”
